Welcome to FixIt500 — a community-driven platform designed to connect homeowners, businesses, and local service providers.
These Terms of Use (“Terms”) govern your use of FixIt500.com (the “Platform”) operated by MCM 4 Small Biz, LLC (“Company,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to these Terms. If you do not agree, please do not use FixIt500.
“Users” = anyone accessing FixIt500.
“Service Providers” = contractors/businesses listed on FixIt500.
“Advertisers” = businesses purchasing paid listings, advertising, sponsorships or promotional services.
1. Platform Purpose
FixIt500 is a platform that connects users with independent contractors and service providers. MCM 4 Small Biz, LLC does not perform, supervise, or guarantee any services provided by third parties.
Users acknowledge that they engage contractors at their own risk and are solely responsible for evaluating, selecting, and entering into agreements with service providers.
Further, FixIt500 is a directory and information platform that aggregates business listings, reviews, project information, and community-submitted content to help users discover and evaluate local service providers.
We are not a contractor, broker, or service provider. We do not perform services, and we do not guarantee outcomes.
2. Use of the Platform
You agree to use FixIt500 only for lawful purposes.
You may:
Search for and contact local service providers
Submit reviews, project information, and recommendations
Request quotes or service inquiries
You may not:
Post false, misleading, or defamatory content
Impersonate another person or business
Upload unlawful, harmful, or infringing content
Attempt to gain unauthorized access to the Platform or its systems
Use of the Platform is also subject to our Privacy Policy, which describes how we collect, use, and protect personal information.
3. User Content & License
By submitting content (including listings, reviews, photos, or project details), you:
Confirm you have the right to share such content
Grant MCM 4 Small Biz, LLC a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute the content in connection with the Platform and its promotion
Accept responsibility for the accuracy and legality of the content
Content may include material generated or enhanced using third-party tools, including artificial intelligence (AI). You are responsible for ensuring such content is truthful, lawful, and does not infringe on the rights of others.
We reserve the right (but are not obligated) to review, edit, or remove content at our discretion.
4. Platform Content & Data Sources
FixIt500 aggregates information from multiple sources, including registered businesses, user submissions, and publicly available data.
We do not independently verify all content and cannot guarantee the accuracy, completeness, or timeliness of all information.
Users should exercise independent judgment and perform appropriate due diligence before selecting or engaging any service provider.
5. Directory Listings & Service Relationships
FixIt500 provides a platform to connect users with independent service providers. Payment for a listing, advertising placement, sponsorship, featured status, or enhanced visibility does not constitute FixIt500's endorsement or guarantee of that business.
We do not endorse, certify, or guarantee any contractor or business
Listing levels or badges (e.g., “Enhanced,” “Pro,” or “Preferred”) reflect participation within the Platform and do not constitute licensing, certification, or endorsement
Any agreement for services is solely between the user and the service provider
Users assume all risk when engaging with contractors or businesses.
5.a. Independent Service Relationships
FixIt500 and MCM 4 Small Biz, LLC are not parties to any contract, agreement, estimate, work order, transaction, or other arrangement between a User and a Service Provider.
Service Providers are independent businesses and are not employees, agents, partners, joint venturers, representatives, or subcontractors of FixIt500 or MCM 4 Small Biz, LLC.
FixIt500 does not control or supervise the manner, means, pricing, scheduling, quality, safety, performance, or completion of services offered or performed by Service Providers. Users and Service Providers are solely responsible for negotiating and agreeing upon the scope of work, pricing, payment terms, warranties, scheduling, and all other terms relating to services.
FixIt500 is not responsible for collecting or remitting payment for services performed by a Service Provider unless expressly stated otherwise. Payments made to FixIt500 for directory listings, advertising, subscriptions, sponsorships, or promotional services are payments for services provided by FixIt500 and are separate from payments between Users and Service Providers.
5.b. No Guarantee of Leads or Results. Paid listings, advertising, sponsorships, featured placement, enhanced visibility, and other promotional services are intended to provide exposure on the Platform. FixIt500 does not guarantee any minimum number of views, impressions, inquiries, leads, customers, projects, revenue, or other business results from participation in the Platform.
6. Service Provider and Advertiser Responsibilities
Service Providers and Advertisers are solely responsible for the accuracy, completeness, and legality of the information, claims, images, credentials, advertisements, and other content they provide or authorize for publication on FixIt500.
By creating, claiming, purchasing, or maintaining a listing or advertisement on the Platform, each Service Provider or Advertiser represents and warrants that:
All information submitted to FixIt500 is accurate and not false, deceptive, or misleading;
It has the authority and necessary rights to submit and authorize the use of all business names, trademarks, logos, photographs, descriptions, and other content provided;
It is solely responsible for obtaining and maintaining all licenses, registrations, permits, certifications, bonds, insurance, and other credentials required by applicable law for the services it offers and the jurisdictions in which it operates;
It will promptly update its listing or notify FixIt500 if material information concerning its business, services, licensing, insurance, contact information, or eligibility to perform advertised services changes; and
Its use of the Platform and provision of services will comply with applicable federal, state, and local laws and regulations.
Unless FixIt500 expressly states otherwise for a specifically identified verification program, FixIt500 does not independently verify or continuously monitor a Service Provider's licenses, insurance, registrations, certifications, qualifications, or other credentials. The presence of a Service Provider on the Platform does not constitute a representation by FixIt500 that the Service Provider is licensed, insured, qualified, or otherwise eligible to perform any particular service.
FixIt500 reserves the right, but assumes no obligation, to request documentation, correct or remove inaccurate information, suspend or remove listings, or terminate participation when information is believed to be inaccurate, misleading, unlawful, outdated, or inconsistent with these Terms.
7. Indemnification (All Users, Service Providers & Advertisers)
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MCM 4 Small Biz, LLC, FixIt500, and their respective owners, members, managers, employees, contractors, agents, affiliates, successors, and assigns from and against claims, demands, actions, damages, liabilities, losses, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
your use of the Platform;
content, information, advertisements, representations, or materials you submit, provide, publish, or authorize;
your violation of these Terms or applicable law;
your infringement or alleged infringement of another person's intellectual property, privacy, publicity, or other rights;
services you offer, advertise, perform, fail to perform, or arrange through or in connection with the Platform;
disputes, injuries, property damage, losses, or other claims arising from your interactions or transactions with another user, Service Provider, Advertiser, or third party; or
for Service Providers and Advertisers, any failure to obtain or maintain licenses, permits, registrations, certifications, bonds, insurance, or other credentials required for their business or services.
FixIt500 reserves the right, at its own expense, to participate in the defense of any matter subject to indemnification under these Terms.
8. Payments & Subscriptions
Certain features of FixIt500 require a paid subscription.
Fees are billed according to the selected plan and billing cycle
Fees are non-refundable except where required by law
We reserve the right to modify pricing or features with reasonable notice.
8.a. Payment Processing.
Payments made to FixIt500 may be processed by third-party payment processors. By submitting payment information, you authorize FixIt500 and its applicable payment processor to process charges associated with your purchase or subscription. FixIt500 does not guarantee the availability of any particular payment method or payment processor. Your use of third-party payment processing services may also be subject to the applicable processor's terms and privacy policies.
8.b. Subscription Changes, Cancellations & Refunds.
Additional information regarding cancellations, refunds, upgrades, and downgrades is available in our Refund & Cancellation Policy, which is incorporated into these Terms by reference.
8.b.i. Automatic Renewal. Recurring subscriptions automatically renew at the billing frequency and price disclosed at checkout unless canceled before the next renewal date. By purchasing a recurring subscription, the Advertiser or Service Provider authorizes FixIt500 and its payment processor to charge the payment method provided for each renewal.
8.b.ii. Cancellation. Subscriptions may be canceled before the next renewal date to prevent future renewal charges. Unless otherwise required by law or expressly stated in writing by FixIt500, cancellation does not entitle the subscriber to a refund or prorated refund for the current subscription period. Paid features may remain available through the end of the paid subscription period.
8.b.iii. Upgrades. Eligible upgrades may receive a credit for the unused portion of the current subscription, where applicable, as calculated and disclosed at the time of upgrade.
8.b.iv. Downgrades. Subscribers may request or select a lower-priced subscription. Downgrades do not result in a refund or credit for any unused portion of the current subscription. Unless otherwise stated at the time of the change, the downgrade will take effect at the end of the current paid subscription period.
8.b.v. Refunds. Subscription, listing, advertising, sponsorship, setup, and other fees paid to FixIt500 are non-refundable once charged except where required by law or where FixIt500 expressly agrees otherwise in writing. FixIt500 may, in its sole discretion, issue a refund, credit, extension, or other accommodation in individual circumstances. Any such accommodation is voluntary and does not create an obligation to provide the same or similar accommodation in other circumstances.
8.b.vi. Failed Payments. If a payment is declined, reversed, disputed, or otherwise unsuccessful, FixIt500 may suspend or limit paid features until the outstanding balance is resolved.
8.b.vii. Pricing Changes. FixIt500 may change subscription prices or features from time to time. Changes affecting an existing recurring subscription will be communicated with reasonable advance notice and will generally apply beginning with a subsequent renewal period rather than retroactively to an already-paid subscription period.
9. Account Termination
We may suspend or terminate accounts that:
Violate these Terms
Provide false or misleading information
Engage in harmful, abusive, or fraudulent behavior
Suspension or termination for violation of these Terms does not entitle the User, Service Provider, or Advertiser to a refund of previously paid fees, except where required by law.

10. Disclaimers
The Platform is provided “as is” and “as available” without warranties of any kind.
We do not guarantee:
The accuracy of listings or reviews
The availability or performance of service providers
That users will obtain desired outcomes from using the Platform
11. Limitation of Liability
To the fullest extent permitted by law:
MCM 4 Small Biz, LLC shall not be liable for any indirect, incidental, consequential, or special damages
We are not responsible for disputes, damages, or losses arising from interactions between users and service providers
Maximum Liability:
Our total liability for any claim shall not exceed the amount paid by the user to the Company for services during the most recent billing period.
For Users who have not paid fees directly to the Company, the Company's aggregate liability shall be limited to the maximum extent permitted by applicable law.
12. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
To the extent permitted by applicable law, disputes arising out of or relating to the Platform or these Terms shall be resolved through binding arbitration on an individual basis in Denton County, Texas, rather than through a jury trial or class action.
Nothing in this section prevents either party from seeking relief in small claims court where the claim qualifies or seeking temporary or injunctive relief from a court of competent jurisdiction where appropriate.
No Class Actions. To the extent permitted by applicable law, disputes must be brought on an individual basis, and neither party may participate in a class, collective, consolidated, or representative action or arbitration.
13. Intellectual Property
All content, branding, and materials related to FixIt500 (excluding user-submitted content) are the property of MCM 4 Small Biz, LLC and may not be used without permission.
14. Changes to These Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
